Job Description

This is a remote home-based position. The ideal candidate should reside in the Houston Area.

JOB FUNCTION/ PURPOSE

The Legal Counsel is responsible for:

  • Working in collaboration with the Human Resources team to support labor and employment matters for the company

  • Managing employment-related litigation

  • Assisting in providing training to different levels of management

  • Monitoring labor and employment trends, best practices, and applicable laws and regulations to help guide business practices.

  • Providing transactional support as needed

The position reports to the General Counsel. Key interactions will include members of the executive team as well as personnel in business development, finance, technical solutions, HR, commercial, and operations.

ESSENTIAL DUTIES AND RESPONSIBILITIES

  • Managing litigation and agency charges related to employment claims in conjunction with outside counsel

  • Work in collaboration with the Human Resources team in day-to-day employee relations matters, ensuring consistency and best practices to reduce risk in areas such as disciplinary actions, performance management and terminations, including reductions in force.

  • Support and advise the Human Resources team in compliance matters and best practices to reduce risk in other operational areas such as leave management, recruiting, diversity/EEO/Affirmative Action, and compensation/payroll.

  • In conjunction with the Human Resources team, take an active role in developing, supporting, or delivering training for the management team around matters connected to employment law and best practices to proactively reduce risk.

  • Advise and maintain documentation on matters related to unions, including grievances and support for negotiations in conjunction with outside counsel

  • Advise and support the HR team to ensure compliance in prevailing wage matters.

  • Advise the business and support the HR team in matters of complying with federal employment laws, regulations, and contract flow-downs.

  • Review and analyze the terms and conditions of contracts related to SAAS-vendors and consultants/professional service providers utilized by corporate support functions, in compliance with corporate policy guidelines and procedures

  • Consult with HR on the development and maintenance of handbook policies and ongoing compliance with other state mandates such as paid leave and employee notice requirements

  • Maintain and monitor use of Inframark employment documents such as consulting agreements, employment agreements, non-compete/non-solicitation agreements, offer letters, severance/separation agreements, and others

  • Administer employee reporting hotline and direct appropriate investigations through to follow-up; advise and support internal stakeholders such as HR, Compliance and H&S on best practices for conducting and documenting internal investigations.

  • As needed, liaise with outside counsel to direct any employee immigration cases.

  • Provide transactional support on contract terms and negotiations related to projects

  • Assist in the development and implementation of policies and processes to improve efficiency and risk management

  • Assist on other legal matters as directed by General Counsel

QUALIFICATIONS

  • JD and current bar membership

  • Minimum 10 years experience practicing in a corporate environment

  • Broad employment law experience, including exposure to labor/union matters, prevailing wage, multi-state compliance issues, and federal contracting requirements

  • Strong customer focus

  • Excellent verbal and written communication skills to be able to communicate effectively at all levels of an organization

  • Strong relationship skills

  • Ability to work independently and exercise judgment

  • Accurate and attentive to detail

  • Excellent time management and organizational skills

  • Demonstrated track record of being proactive and focused on continuous improvement

  • Effective interpersonal communication skills to interact with internal clients and colleagues in a collaborative, pragmatic and productive fashion

  • Personal aptitude to thrive in a dynamic, fast-paced environment and managing competing demands with tact and diplomacy

  • Strong computer skills including Microsoft Office applications
